The legal context around child defendants remains complicated and there is persisting confusion about how to deal with the welfare needs of children charged with serious offences. In many ways, society prefers to perceive children either as victims of crime or as offenders. Therefore, the dual status of many child offenders as children in need as well as young delinquents has been difficult to address within current civil and criminal legislation.
