Abstract

Discusses two cases on the Hague Convention, namely: (1) the House of Lords decision in Re M (Children) (Abduction) on whether the court had discretion under the Hague Convention to order the return of two children to Zimbabwe when the children had been settled in the UK for two years or whether the children's welfare was paramount; and (2) the South African Supreme Court of Appeal decision in Central Authority v Houwert on whether a father had agreed to his child's removal to, or retention in, South Africa.
