Abstract

Examines the proposals of the Scottish Law Commission's 2007 discussion paper on succession dealing with intestate succession where the deceased is survived by a spouse or civil partner, including the rules that should apply where the deceased also had issue, stepchildren, and other accepted children. Presents a hypothetical case study illustrating the application of these rules where two unrelated families are joined together as a result of a second marriage.
