Abstract

In recent years there has been growing interest in the concept of a relational contract which might be defined as a ‘contract that involves not merely an exchange, but also a relationship between the contracting parties’. The employment contract is now often categorised as relational in nature but it is less than clear whether that is sufficient to provide a deeper understanding of legal doctrine. In part this is because, at least in England, the case law has yet to tell us a great deal about what the judiciary mean by the concept.
