Abstract

The United Nations Convention on the Rights of the Child (UNCRC) has recently been incorporated into Scots Law in 2024 ("UNCRC (Incorporation) (Scotland) Act 2024," 2024). However, this focus on children’s rights in Scotland is not new, as can be seen by the Education (Additional Support for Learning) (Scotland) Act 2004 (as amended 2009) (ASL Act), Getting it Right For Every Child (GIRFEC) (Scottish Government, 2010) and the Children and Young People (Scotland) Act 2014, the last of which set out the right for all children to learn in an environment best suited to their needs. The ASL Act sets out the duties of education authorities and the rights of parents, children and young people to additional support for learning. The subsequent Children and Young People (Scotland) Act 2014 strengthens the rights of children and young people, thus enhancing the nation’s compliance with the UNCRC.
