Reports on Scottish cases where parents removed their children from their country of habitual residence and brought them to Scotland, and the other parents sought the children's return. Examines whether the Scottish court can take the children's welfare into account, and how to determine whether parents abroad have rights of custody. Discusses whether the Hague Convention on the Civil Aspects of International Child Abduction 1980 has failed to achieve its objective of deterring abduction.
